Where Your Divorce Cases Most Often Go Sideways

The marital home is where most divorce cases get stuck. Equity disputes drag negotiations. One spouse stops maintenance. The other blocks showings. Valuation disagreements create stalemates. Court-ordered sales sit on the market for months. Every delay costs your client equity, your firm billable inefficiency, and your case its momentum.

The hard reality: Working with a generalist real estate agent on a divorce case means inheriting the risk of their inexperience. They don't understand court timelines. They don't know how to neutrally communicate with two contested spouses. They don't identify mortgage liability issues, capital gains timing, or DTI/alimony interactions until those issues become emergencies — and by then, your client's options have narrowed dramatically.

What a Dually-Certified Specialist Provides Your Practice

⚖️

Neutral Representation

Specialist represents the sale, not one spouse against the other. Documented neutrality at every decision point. Eliminates bias claims and protects against post-decree disputes.

📋

Court-Ready Documentation

Defensible CMAs, written decision logs, communication records, and timeline documentation. Satisfies judicial requirements and supports expert testimony if cases proceed to litigation.

🎯

Risk Identification

Mortgage liability, title issues, condition risks, valuation gaps, DTI/alimony timing, capital gains exposure — identified early and incorporated into your case strategy before they become problems.

30-Day Closings

Specialist-handled divorce sales close in 30-60 days vs. 100-120 day general market. Less time co-owned. Less time for disputes. Faster resolution. Cleaner case files.

🤝

Attorney Workflow Support

Direct attorney communication. Same-day response. Pre-decision consultation on major moves. Documentation aligned with court schedules. Built around how attorneys actually work.

💰

Complimentary to Attorneys

No fee for consultation, document review, risk assessment, or strategic guidance. Specialist is only compensated through standard commission when (and if) the property sells through their representation.

How It Works for Your Practice

A simple, attorney-friendly workflow built around how family law firms actually operate.

1

Refer the Client (Or Call Yourself First)

Have your client call directly, schedule online, or contact me yourself before referring. Many attorneys prefer a 15-minute introductory call before sending clients — that's welcomed.

2

Complimentary Consultation

30-60 minute meeting (in person, by phone, or video). Reviews divorce decree or temporary orders, property condition, initial valuation, risk identification, timeline projection. Written summary provided for your case file.

3

Ongoing Case Support

Updated valuation analyses, court filing documentation, spouse communication, professional coordination (appraisers, inspectors, lenders), expert testimony preparation, settlement scenario modeling — all at no cost to you or your client.

4

Sale Execution (If/When Parties Agree)

If both spouses agree to retain the specialist for the sale, listing, marketing, negotiation, and closing proceed with full attorney coordination. Commission paid from sale proceeds at closing per standard real estate practice. No retainer. No obligation.

5

Clean Documentation Transfer

Closing documents, distribution records, and final reports delivered to both attorneys. Court-aligned records support post-decree compliance and prevent the disputes that often pull cases back into your office months later.

Notable Case Experience

Names confidential. Outcomes documented. Across all Utah divorce real estate transactions: 100% success rate.

Spousal Sabotage of Repairs

One spouse began undoing pre-listing repairs to delay sale. Coordinated strategy with family law attorney resulted in court-supported intervention, documented sabotage, and closing within 45 days.

Non-Paying Ex Discovery

Decree assigned mortgage to one spouse who then stopped paying. Other spouse discovered late payments on their credit 60 days post-divorce. Emergency intervention accelerated sale to closing in 32 days.

Post-Settlement Bankruptcy

Settlement awarded home and debt to one spouse, who declared bankruptcy six months later. Other spouse still on mortgage faced unexpected liability. Coordinated sale satisfied liens and protected the non-bankrupt spouse.

High-Conflict 30-Day Close

Contested divorce with non-cooperative spouses and ongoing legal disputes. Through neutral handling and proactive issue resolution, property went under contract in 18 days and closed in 32 days from listing.

Hidden Damage Discovery

Pre-listing inspection identified $40,000+ in hidden structural and water damage previous evaluations missed. Early identification enabled legal coordination on repair credits, accurate pricing, and disclosure documentation.

Property Neglect & Lien Resolution

Property left vacant and neglected during contested divorce, with unrecorded contractor liens discovered during title search. Coordinated cleanup, lien resolution, and sale closing within Utah Code §30-3-5 timelines.

The Two-Path Advantage Most Attorneys Don't Know Exists

Most divorce real estate specialists can only sell homes. When pre-listing work is required (repairs, painting, decluttering), the attorney and client become project managers coordinating contractors during one of the worst times of their lives.

Frequently Asked Questions From Attorneys

What does "complimentary to attorneys" actually mean?

No fee for consultation, document review, risk assessment, or ongoing case support. The specialist is compensated only through standard real estate commission if (and only if) the property is sold through their representation. There is no retainer, no consultation fee, no obligation.

What's the difference between RCS-D™ and CDRE™?

Both are specialized certifications for divorce real estate from different leading organizations. RCS-D™ focuses on collaboration with attorneys, mediators, and CPAs. CDRE™ (Ilumni Institute, founded by Prof. Kelly Murray, JD) focuses on neutral representation, court compliance, and dispute prevention. Less than 1% of agents nationally hold either certification. Holding BOTH places a specialist in an extremely small group.

How does neutral representation work when spouses disagree?

The specialist represents the sale, not one spouse against the other. Equal information flow to both spouses (and their attorneys). Pre-decision consultation on major moves. Documented neutrality on contested questions. When spouses genuinely disagree, the specialist presents both sides to attorneys for legal guidance rather than taking a position.

Can the specialist provide expert testimony at trial?

Yes. A dually-certified specialist can serve as an expert witness on valuation, market analysis, property condition, sale timeline expectations, and other real estate matters within their area of expertise. Documentation maintained during the case (CMAs, communication records, decision logs) supports testimony preparation.

What if one spouse refuses to cooperate with the sale?

Documentation of the obstruction, communication through both attorneys, continued forward movement on items not requiring the obstructing spouse's signature. If obstruction continues, the attorney can file for court intervention under Utah Code §30-3-5, giving the court authority to compel sale or authorize agents to act without the obstructing spouse's signature.

Statewide or only St. George?

Primary practice serves all of Washington County (St. George, Hurricane, Washington, Ivins, Santa Clara). Treasured Properties also serves clients throughout Northern Utah through Real Brokerage's statewide infrastructure. Cross-region cases (Southern Utah attorney with Northern Utah property, or vice versa) can be coordinated.

How do I introduce this service to my clients?

Three options: (1) Have the client call directly: (435) 264-1444. (2) Use the online scheduling link at calendly.com/treasuredproperties. (3) Refer through email and we'll handle initial contact. For attorneys who want to introduce themselves first, attorney-only consultations are welcomed before client referral.
